Pension Dallgow General Terms and Conditions

1. The General Terms and Conditions of Pension Dallgow stated below apply from 8 February 2008 to any and all accommodation contracts that are automatically entered into whenever single guest rooms or several rooms are rented to individuals or groups, as well as to any and all related work and services provided to the client (guest). These terms and conditions also apply if no written contract was entered into but the accommodation arrangement was agreed upon by the parties as a result of a face-to-face conversation, by telephone or facsimile, or via email. Guests accept that their own terms and conditions, which might run counter to these General Terms and Conditions, do not apply.
2. Booking changes or cancellations: When guest rooms are booked, the guesthouse management sends a booking confirmation to the guest by facsimile or email, in which the terms for optional bookings, cancellations and payments are stated. These terms need not be expressly re-confirmed by the guest; they fully apply to both parties upon confirmation by the guesthouse. Any changes to the booking or cancellations must be made in writing or sent either by facsimile or by email. Any verbal arrangements agreed upon by telephone are not legally binding in the event of any dispute that might arise at a later stage. The following terms apply to cancellations: For holiday apartments and rooms: cancellation up until the 30th day before the date of arrival = 10% of the rate; cancellation from the 29th to 25th day before the date of arrival = 50% of the rate; cancellation from the 24th to 10th day before the date of arrival = 70% of the rate; from the 9th day to the date of arrival = 100% of the rate. If the landlord is not able to process the booking for compelling internal reasons, he/she shall be entitled to reasonably change the booking to other guesthouses/hotels. Any resulting rate differences shall be borne by the landlord.
3. Payment terms:
   a) General Terms of Payment. The guest may only set off or reduce the rate in the case of an undisputed or legally valid claim against the guesthouse. If the guest cancels his/her stay prematurely, he/she shall be bound to pay the remainder of the rate nonetheless, unless he/she proves that the guesthouse has failed to rent the room or apartment to another guest as far as reasonably possible, or unless he/she provides another guest replacing him/her at the same rate.
   b) Individual and group bookings: The agreed room rates generally include all taxes and services. The rate for accommodation and all other services rendered to the guest is usually payable on the date of arrival of the individual guest/group. The rental rate must be paid in cash.
4. No-smoking policy: Upon prior request, Pension Dallgow will allow its guests to smoke. Ashtrays will be provided. It is strictly prohibited to smoke in bed.
5. Rates: The current list of rates can be obtained from www.pension-dallgow.de or requested directly at the guesthouse at any time.
6. Valuables: Pension Dallgow expressly excludes any liability for the loss of valuables, in particular jewellery and cash. The guest shall also be solely responsible for the safe and secure storage of any clothes, musical instruments, technical equipment or similar items.
7. Liability: The guest shall be liable for any damage or loss caused by him/her. The guest is under the obligation to notify the guesthouse of any storage or use of hazardous or illegal products or items at the premises (such as drugs, explosives or firearms).
8. Technical equipment: Under the accommodation contract entered into, the guest may use the computers of the guesthouse only after prior consultation of the guesthouse management. The use of any Internet sites displaying content that is pornographic, criminal or promoting violence, or any other similar content, is strictly prohibited.
9. Termination of contract by the guesthouse: Pension Dallgow shall be entitled to terminate accommodation contracts with immediate effect (also after the guest has occupied his/her room) and to exercise its right to enforce the house rules by evicting guests or groups from the premises if they damage or compromise the reputation and safety and security of Pension Dallgow, or if they are suspected of committing criminal acts or harass, repeatedly disturb, inconvenience or put at risk other guests, inhabitants, passers-by or neighbours. In particular, the guesthouse shall be entitled to terminate the contract with immediate effect if guests or groups repeatedly violate the provisions of these General Terms and Conditions or the house rules on display at the premises, or if they damage, soil or steal items in the ownership of the guesthouse. This provision also applies if the guest uses his/her room or other premises of Pension Dallgow for purposes other than agreed upon under the contract. In such a case, the guest may be obliged to pay for the rental period already elapsed and/or for the remainder of the rental period, or to pay damages to the guesthouse, in accordance with the cancellation terms stated in section 2 of these General Terms and Conditions.
10. Venue for any legal dispute arising from these General Terms and Conditions shall be Amtsgericht Nauen (Nauen District Court).
11. Final provisions: Should one or more provisions contained in these General Terms and Conditions governing the conclusion of accommodation contracts be invalid, this shall not affect the validity of the remaining provisions. In such a case, the invalid provision shall be replaced with a statutory provision that comes as close as possible to the original provision. Any deviations from these General Terms and Conditions, as well as any collateral agreements, must be agreed upon in writing.
